SCHEDULE Additional Territories
Part A – Scope and Interpretation
1. This Schedule applies to you if you use the User Services in one of the territories listed below (each a “Covered Territory”). It forms part of, and must be read together with, the User Terms of Service (the “Terms”) available at https://sundayapp.com/en-gb/user-terms-of-service/.
2. In the event of any conflict between this Schedule and the Terms, this Schedule prevails to the extent of the inconsistency and only in respect of the relevant Covered Territory.
3. Capitalised terms used but not defined in this Schedule have the meaning given to them in the Terms.
4. The Covered Territories are: Ireland, Italy, Spain and Belgium (collectively the “EU Territories”) and the Emirate of Dubai, United Arab Emirates (“Dubai”)
Part B – EU Territories: General Provisions
The following provisions apply to all EU Territories, in addition to the Terms.
5. Governing Law and Mandatory Consumer Protections
The Terms are governed by the laws of England and Wales (Section 7.2 of the Terms). In accordance with Article 6(2) of Regulation (EC) No 593/2008 (Rome I) and as acknowledged in Section 7.2 of the Terms, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your habitual residence. Where such mandatory provisions provide you with greater protection than the equivalent provisions of English law, those mandatory provisions apply.
6. Right of Withdrawal
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and equivalent provisions implementing Directive 2011/83/EU in each EU Territory, you may have a right to withdraw from a distance contract within 14 days. However, in accordance with the applicable exceptions (including Article 16(a) of Directive 2011/83/EU and its local transpositions), no right of withdrawal applies to services that have been fully performed before the end of the withdrawal period with your prior express consent and acknowledgement that you will lose your right of withdrawal. Payment of a bill via the Sunday App constitutes a service fully performed upon completion of the payment transaction.
7. Alternative Dispute Resolution
In addition to the dispute resolution mechanism described in Section 7.4 of the Terms, consumers in all EU Territories may access the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Where the law of your EU Territory requires the designation of a local ADR body, the body applicable to you is specified in Part C below.
8. Data Protection
Sunday’s processing of your personal data is governed by Regulation (EU) 2016/679 (GDPR) and the privacy policy available at https://sundayapp.com/en-gb/privacy-policy/. Your rights as a data subject under the GDPR apply in full. Where the law of an EU Territory imposes additional requirements (for example, on the exercise of data subject rights or on specific categories of processing), the relevant provisions are noted in Part C below.
9. Service Fees and Price Transparency
Any service fees charged for the use of User Services (as described in Section 3 of the Terms) are displayed to you, inclusive of all applicable taxes, before you confirm payment. In accordance with Directive 2011/83/EU and its local transpositions, you will not be required to pay any charges that were not clearly disclosed prior to your confirmation of payment. You are never required to use the Sunday App to pay your bill; payment by card directly to the Establishment remains available as an alternative not subject to the service fee.
10. Liability Limitations and Unfair Terms
The limitations and exclusions of liability set out in Section 6 of the Terms apply to the fullest extent permitted by the mandatory provisions of the law of your EU Territory. To the extent any limitation or exclusion in the Terms would constitute an unfair term under the law of your EU Territory implementing Directive 93/13/EEC (Unfair Contract Terms Directive), such limitation or exclusion shall be deemed amended to the minimum extent necessary to render it enforceable.
11. Contracting Entity
Notwithstanding the identification of Sunday App Limited in the Terms, for the EU Territories your contract is with Sunday SAS, a company incorporated in France with registered office at 112 avenue de Paris, CS 60002, 94306 Vincennes Cedex, France (RCS Créteil 898 082 625), registered with ORIAS under number 26002072 as a mandataire non exclusif en opérations de banque et en services de paiement and supervised by the Autorité de Contrôle Prudentiel et de Résolution (ACPR).
Part C – EU Territories: Country-Specific Provisions
12. Ireland
(a) Consumer Protection References
For consumers habitually resident in Ireland, the mandatory provisions of the Consumer Rights Act 2022 (as amended) and the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (S.I. No. 484/2013) apply to the extent they afford greater protection than the Terms.
(b) Jurisdiction
Notwithstanding Section 7.3 of the Terms, for consumers habitually resident in Ireland, any proceedings may be brought in the courts of Ireland in accordance with Article 18(1) of Regulation (EU) No 1215/2012 (Brussels I Recast).
(c) ADR Body
Consumers in Ireland may submit complaints to the Competition and Consumer Protection Commission (CCPC), which can direct consumers to the relevant ADR entity. The European ODR platform is also available.
(d) Language
English is an official language of Ireland. The Terms and this Schedule are provided in English and no translation is required.
13. Italy
(a) Consumer Code References
For consumers habitually resident in Italy, the mandatory provisions of the Codice del Consumo (Decreto Legislativo 6 settembre 2005, n. 206), as amended, apply to the extent they afford greater protection than the Terms.
(b) Unfair Terms
Articles 33–37 of the Codice del Consumo (transposing Directive 93/13/EEC) apply. To the extent that any clause in the Terms would be considered presumptively unfair (clausola vessatoria) under Article 33(2) or would require specific approval under Articles 1341–1342 of the Italian Civil Code, such clause shall be ineffective to the extent provided by mandatory Italian law. The remainder of the Terms continues to apply.
(c) Jurisdiction
Notwithstanding Section 7.3 of the Terms, for consumers habitually resident in Italy, exclusive jurisdiction lies with the court of the consumer’s place of residence or domicile, in accordance with Article 66-bis of the Codice del Consumo.
14. Spain
(a) Consumer Protection References
For consumers habitually resident in Spain, the mandatory provisions of the Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios (TRLGDCU), as amended, apply to the extent they afford greater protection than the Terms.
(b) Complaints
In accordance with Article 21 TRLGDCU, Sunday makes available a customer service contact at support@sundayapp.com and will acknowledge receipt of any complaint within one (1) month. Consumers in Spain may also submit complaints to the consumer arbitration board (Junta Arbitral de Consumo) of their autonomous community.
(c) Jurisdiction
Notwithstanding Section 7.3 of the Terms, for consumers habitually resident in Spain, the courts of the consumer’s domicile have exclusive jurisdiction in accordance with Article 52(2) of the Ley de Enjuiciamiento Civil, read together with Article 90(2) TRLGDCU.
15. Belgium
(a) Consumer Protection References
For consumers habitually resident in Belgium, the mandatory provisions of Book VI of the Code de droit économique (CDE) apply. To the extent any provision of the CDE affords greater protection than the Terms, that provision prevails.
(b) ADR Body
In addition to the mechanisms described in Section 7.4 of the Terms, Belgian consumers may submit complaints to the Service de Médiation pour le Consommateur (Boulevard du Roi Albert II, 8 Boîte 1, 1000 Brussels – https://mediationconsommateur.be).
(c) Jurisdiction
Notwithstanding Section 7.3 of the Terms, for consumers habitually resident in Belgium, any dispute may be brought before the courts of the consumer’s domicile in accordance with Article 624 of the Code judiciaire.
(d) Language
The Terms and this Schedule are provided in English. For consumers in the Brussels-Capital Region and Wallonia, this is generally acceptable. For consumers in the Flemish Region or the German-speaking Community, a Dutch or German translation may be required if Sunday actively targets consumers in those regions.
Part D – Dubai
16. Application
This Part D applies to you if you use the User Services in the Emirate of Dubai, United Arab Emirates. The provisions of Parts B and C do not apply to you.
17. Contracting Entity
Notwithstanding the identification of Sunday App Limited in the Terms, for Dubai your contract is with Sunday SAS, a company incorporated in France with registered office at 112 avenue de Paris, CS 60002, 94306 Vincennes Cedex, France (RCS Créteil 898 082 625). Sunday does not maintain a local entity in the UAE.
18. Governing Law and Jurisdiction
(a) The Terms are governed by the laws of England and Wales (Section 7.2 of the Terms).
(b) Any dispute arising out of or in connection with the Terms or this Schedule shall be subject to the exclusive jurisdiction of the courts of England and Wales, as set out in Section 7.3 of the Terms.
19. UAE Consumer Protection
UAE Federal Law No. 15 of 2020 on Consumer Protection (as amended) applies to the extent it imposes mandatory obligations on suppliers of services to consumers in the UAE. Nothing in the Terms limits or excludes any right that you have under that law which cannot be limited or excluded by agreement.
20. Data Protection
(a) Sunday’s processing of your personal data is described in the privacy policy available at https://sundayapp.com/en-gb/privacy-policy/.
(b) To the extent that your personal data is processed in or in connection with services provided in the UAE, the UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL), as implemented by its executive regulations, applies. Sunday will process your personal data in accordance with the PDPL and will ensure that any cross-border transfer of your personal data complies with the requirements of the PDPL.
21. Alcohol
Section 3.1 of the Terms (Alcoholic Beverage Orders) is modified as follows for use in Dubai: Sunday acts solely as a technology provider to the Establishment. The sale and service of alcoholic beverages is the sole responsibility of the Establishment, which must hold a valid licence issued by the relevant authority in Dubai. You represent and warrant that you are of legal age to purchase alcohol in the UAE (21 years of age or older) and are not prohibited by law from purchasing or consuming alcohol.
22. Tipping and Donations
Sections 3.3 and 3.4 of the Terms apply in Dubai. Tips left via the Sunday App are voluntary and at your sole discretion. Any donations made via the Sunday App will be directed only to associations or organisations that are duly licensed or registered in the UAE.
23. Currency
Where the User Services are used in Dubai, prices and bills are displayed in UAE Dirhams (AED) unless the Establishment specifies otherwise.
Part E – Adding a New Covered Territory
24. When Sunday extends the User Services to a new territory, this Schedule may be updated by adding a new section under the relevant Part, covering at a minimum: (a) the applicable local consumer protection framework; (b) the competent courts for consumer disputes; (c) the applicable ADR body (if any); (d) any language requirements for the valid incorporation of general terms; (e) any data protection requirements beyond those addressed in the Terms and privacy policy; and (f) any territory-specific modifications to the User Services (e.g. alcohol, tipping, currency). No amendment to the Terms themselves is required.
