Sunday for Staff Terms of Use

PLEASE READ CAREFULLY. These Terms of Use (the “Terms”) form a binding agreement between Sunday App Limited, a company incorporated under the laws of England and Wales (company number 13305830), whose registered office is at 3rd Floor, 1 Ashley Road, Altrincham, Cheshire, WA14 2DT (“we”, “Sunday”, or “us”), and you, the individual accepting these Terms when registering with Sunday for Staff (“you” or the “Staff Member”).
These Terms govern your use of the Sunday for Staff mobile application (“SFS”) and the Services provided to you through it, including access to performance and operational information, tronc allocation data (where applicable), and the Sunday Rewards Programme.
These Terms must be read alongside our Privacy Policy applicable to staff, available at sundayapp.com/en-gb/privacy-policy-waiters-personnel/, which explains how we collect, use, and share your personal data in connection with the Services.
The provision of the Services requires your prior acceptance of these Terms. By accepting these Terms, you confirm that you have read and agreed to them. If you do not accept these Terms, you may not use SFS or receive the Services.
We may update these Terms from time to time to reflect changes in the Services or applicable law. If we make material changes, we will provide you with reasonable notice, such as by posting an update in SFS or sending you an email or push notification. Your continued use of SFS after such notice and the effective date of the changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using SFS before the changes take effect.
Capitalised terms used in these Terms have the meanings given in Article 14 (Definitions) or in the relevant clause where they appear.
TITLE I – SFS PLATFORM AND INFORMATION SERVICES
Article 1 – Overview of SFS and the Information Services
1.1 SFS is a mobile application developed by Sunday that serves as a digital platform for hospitality employees. Through SFS, you can access:
- operational and performance information relating to your work at the Establishment (e.g. guest satisfaction scores, table performance, digital payment adoption metrics);
- tronc allocation data, where the Merchant uses a tronc scheme administered by a third-party tronc administrator (see Article 2); and
- the Sunday Rewards Programme, as described in Title II below.
1.2 SFS is provided to you at no charge. However, standard data and messaging rates from your mobile carrier may apply when downloading or using SFS. You are solely responsible for any such charges, as well as for maintaining a compatible device and internet connection.
1.3 Sunday may modify, update, or discontinue features of SFS at any time, with reasonable notice where practicable.
Article 2 – Display of Tronc Allocation Data
2.1 Where the Merchant at whose Establishment you work operates a tronc scheme administered by a third-party tronc administrator (e.g. WMT Troncmaster Services Limited, operating as “TroncBox”), we may display certain tronc allocation data within SFS for your information. This data is received from the tronc administrator and is presented within SFS for transparency purposes only.
2.2 Sunday does not administer, manage, or calculate tronc allocations. The tronc administrator is solely responsible for the design and application of the tronc allocation methodology. Sunday makes no representations or warranties regarding the accuracy, completeness, or fairness of the tronc allocation data displayed within SFS.
2.3 If you have any questions or concerns about your tronc allocations, you should contact the tronc administrator or the Merchant directly. Sunday is not able to resolve disputes relating to tronc calculations or distributions.
2.4 The display of tronc data within SFS is subject to the continued availability of the integration between Sunday and the tronc administrator. Sunday may cease displaying tronc data at any time if the integration is discontinued, the Merchant’s arrangements change, or for any other operational reason.
Article 3 – Performance Data Sharing
3.1 Where the Merchant has instructed us to do so in connection with a tronc scheme, we may share certain performance data derived from the Sunday platform (“Sunday Data”) with the Merchant’s tronc administrator. Sunday Data may include guest satisfaction scores, spend per head, table turn times, digital payment adoption metrics, and platform usage indicators.
3.2 This sharing is carried out on the instruction of the Merchant, for the purpose of enabling the tronc administrator to design and apply its tronc allocation methodology. The tronc administrator acts as an independent data controller in respect of any Sunday Data it receives.

TITLE II – SUNDAY REWARDS PROGRAMME
Article 4 – Overview of the Programme
4.1 The Sunday Rewards Programme (the “Programme”) offers promotional incentives to eligible staff members (“Eligible Servers”), who may accrue promotional rewards (points or credits, each a “Reward”) upon completion of specific qualifying actions during their shifts. The Programme is designed to encourage the use of Sunday’s payment solutions.
4.2 Rewards, qualifying events, and redemption terms are communicated via SFS and may vary by campaign, time, and location. Rewards are promotional incentives and have no cash value until redeemed.
4.3 Sunday reserves the right to modify, suspend, or terminate the Programme at any time, in accordance with these Terms.
Article 5 – Eligibility
5.1 To participate in the Programme as an Eligible Server, you must:
- be at least 18 years of age;
- work as a server or member of staff in an eligible Establishment located in the United Kingdom;
- have registered and maintain an active SFS Account; and
- satisfy any additional eligibility criteria communicated by Sunday through SFS.
5.2 Participation in the Programme is personal to you and may not be assigned, transferred, or sublicensed to any other person.
Article 6 – Rewards
6.1 Rewards accrue as promotional incentives through qualifying events that occur during your active shifts at a participating Establishment. A “qualifying event” is an action that meets the criteria described in SFS, which may include, for example, a Customer using a Sunday payment solution to pay a bill for a table you served, or other service activity attributed to you through the linked POS system.
6.2 Whether an action qualifies for a Reward will be determined by Sunday in its sole discretion based on data received from the POS system and/or the Sunday payment solution. Only transactions and qualifying events properly linked to your SFS Account and verified as occurring during your active shift will be eligible.
6.3 Qualifying criteria may be updated from time to time and will be described in SFS. Any such changes will apply only to events occurring after the effective date of the update and will not affect Rewards already earned or pending under prior criteria.
6.4 Reward amounts and conditions for earning them are determined by Sunday and displayed in SFS. They may vary depending on campaign, time, location, or Establishment. All Reward amounts and conditions are subject to change at Sunday’s discretion. Any such changes will apply prospectively and will not affect Rewards already earned or pending.
6.5 Sunday may limit the total amount of Rewards awarded to any Eligible Server in a calendar year. Any such cap will be specified in SFS.
6.6 Rewards are promotional points only and do not represent stored value, cash, wages, or property. Rewards have no cash value until you submit a redemption request and it is approved and processed by Sunday’s regulated third-party payment provider.
6.7 Any display of Rewards or balances in SFS is for tracking purposes only and does not represent funds held by Sunday. Rewards that are accrued but not redeemed within the specified time period will expire automatically and cannot be reinstated.
6.8 To redeem Rewards, you must:
- where applicable and requested by Sunday, link a personal UK bank account to your SFS Account;
- be the legal owner of the linked account and authorised to receive funds; and
- complete all required identity verification (KYC) and anti-money laundering (AML) checks.
6.9 Disbursements will be made in accordance with the schedule and methods provided in SFS. Sunday is not responsible for delays caused by incorrect or outdated account details or your non-compliance with regulatory requirements.
6.10 Rewards that have been accrued but not redeemed will expire if the Establishment at which they were accrued ceases to use Sunday’s services prior to redemption or if your employment at the Establishment ends.
6.11 We reserve the right to reverse Rewards in cases where:
- the underlying transaction is refunded, voided, cancelled or otherwise deemed invalid;
- Rewards were earned through error, fraud, misuse of SFS, or breach of these Terms; or
- you fail to maintain an active, eligible SFS Account in good standing.
6.12 Improperly issued Rewards may be recovered (e.g. by offsetting future payouts). By participating in the Programme, you authorise such reversals and offsets.
Article 7 – No Employment Relationship
7.1 Promotional incentives. Rewards are promotional incentives offered by Sunday and are not wages, tips, tronc allocations, or compensation from your Employer. Rewards are not a substitute for wages owed to you by your Employer.
7.2 Independent status. Participation in the Programme and use of SFS is entirely voluntary and does not create any employment, partnership, agency, or joint venture relationship between you and Sunday.
7.3 No employment benefits. Nothing in these Terms shall be construed as entitling you to any compensation, benefits, or protections that Sunday provides to its own employees, including but not limited to wages, holiday pay, pension contributions, insurance coverage, or statutory sick pay.
7.4 Responsibility for taxes. You are solely responsible for reporting and paying any applicable taxes or other legal obligations arising from your receipt of Rewards. Rewards may constitute taxable income. Sunday is not responsible for your tax compliance or liabilities. You should seek independent tax advice if necessary.
TITLE III – GENERAL PROVISIONS
Article 8 – SFS Account Creation and Management
8.1 To use SFS and benefit from the Services, you must create and maintain a Sunday Staff Account (“SFS Account”). This account is a user profile within SFS and is not a bank account. To create an SFS Account, you must:
- Download SFS from the applicable app store.
- Provide the required registration information, including your full name, a verified mobile phone number, and a valid email address.
- Complete any identity verification or “Know Your Customer” (KYC) checks that may be required by Sunday or its third-party service providers.
8.2 Where applicable, you may be asked to link your SFS Account to the Merchant’s point of sale (POS) system. This connection allows Sunday to access information about your service activity (such as closed tables) for the purposes of:
- attributing operational performance metrics to you;
- tracking qualifying events for the Programme; and
- generating the Sunday Data that may be shared with a tronc administrator under Article 3.
8.3 By linking accounts, you represent and warrant that you have the necessary rights and permissions from the Merchant to authorise this connection. Sunday will not modify, add to, or delete any data within the POS system.
8.4 You are solely responsible for all activities conducted through your SFS Account. You must not allow anyone else to access your account. You are responsible for ensuring that all information you provide is accurate and up to date.
8.5 Eligibility. By creating an SFS Account, you represent that you are at least 18 years of age and are based in the United Kingdom.
Article 9 – Notifications
By accepting these Terms, you consent to receive communications from Sunday via email, push notifications, and/or other electronic messaging. These communications may include service updates, performance information, Reward activity, and promotional information about the Services. You may manage your notification preferences within SFS or by contacting us.
Article 10 – Privacy
The privacy of your personal data is very important to us. All personal data you provide to us or that we collect about you will be processed in accordance with our Privacy Policy applicable to staff, available at [sundayapp.com/en-gb/privacy-policy-waiters-personnel/]. That policy explains what personal data we collect, why and how we collect it, how we store, use, and share it, your rights in relation to it, and how to contact us or the Information Commissioner’s Office (ICO) if you have any questions or complaints.
Article 11 – Intellectual Property
11.1 Ownership. As between you and Sunday, Sunday owns all rights (including intellectual property rights) in and to SFS and the Services, including all content, branding, designs, software, and databases.
11.2 Licence. Sunday grants you a limited, personal, revocable, non-exclusive, and non-transferable licence to use SFS solely for the purposes described in these Terms. You may not reproduce, modify, distribute, sell, or otherwise exploit SFS or any of its components for any other purpose.
11.3 Feedback. If you submit any suggestions, ideas, feedback, or other information about SFS or the Services (“Feedback”), you agree that Sunday shall have the unrestricted, worldwide, perpetual, irrevocable, royalty-free right to use, reproduce, modify, distribute, and otherwise exploit such Feedback for any purpose, without any obligation or compensation to you.
Article 12 – Liability
12.1 SFS and your SFS Account are provided on an “as is” and “as available” basis. We do not warrant that SFS will be uninterrupted, error-free, secure, or free from viruses or other harmful components. While we use reasonable efforts to ensure availability and security, you are responsible for your own device security and internet connection.
12.2 To the extent permitted by law, we exclude all implied warranties, including warranties of satisfactory quality, fitness for a particular purpose, and accuracy of information.
12.3 Subject to Article 12.5, Sunday will not be liable for any:
- indirect, incidental, consequential, special, or punitive damages;
- loss of profits, revenue, wages, anticipated savings, business opportunities, or goodwill;
- loss or corruption of data; or
- damages arising from reliance on data obtained from third-party platforms (including POS systems or tronc administrators),
whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, even if Sunday has been advised of the possibility of such damages.
12.4 To the fullest extent permitted by law, Sunday’s total aggregate liability to you arising out of or in connection with these Terms, the Services, or SFS shall not exceed £500 (five hundred pounds sterling).
12.5 Nothing in these Terms excludes or limits our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot be excluded or limited under applicable law.
12.6 Sunday makes no representations or warranties regarding the accuracy, completeness, or consistency of tronc allocation data received from a tronc administrator and displayed within SFS. Sunday shall not be liable for any errors, omissions, or discrepancies in such data. All queries regarding tronc allocations should be directed to the tronc administrator or the Merchant.
12.7 You agree to indemnify and hold harmless Sunday and its officers, directors, employees, and agents against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of SFS, or your violation of applicable law.
Article 13 – Term, Suspension, and Termination
13.1 These Terms come into effect when you create your SFS Account (the “Effective Date”) and remain in force until terminated by either party in accordance with this Article.
13.2 You may stop using the Services at any time by deleting your SFS Account through SFS or by emailing support@sundayapp.com. Upon account deletion:
- you will no longer be able to access the Services or accrue Rewards;
- any Rewards validly earned and pending redemption will be paid within 60 days, less any amounts owed to Sunday.
13.3 We may suspend or terminate your access to SFS and/or the Services, upon notice, if:
- you breach these Terms;
- you present a legal, operational, financial, or fraud risk;
- we cease offering the Services or the Programme;
- the Establishment where you work stops using Sunday’s services; or
- at the request of a third-party service provider.
13.4 Termination will not affect any rights accrued before the termination date, including your right to receive Rewards validly earned.
Article 14 – Miscellaneous
14.1 Governing law and jurisdiction. These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms (including any non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14.2 Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sunday concerning the use of SFS and the Services, and supersede all prior or contemporaneous understandings, communications, and agreements on the subject matter.
14.3 Assignment. You may not transfer any of your rights or obligations under these Terms to another person. We may transfer our rights under these Terms, provided that your rights are not materially affected.
14.4 Severability. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remainder of these Terms, which shall continue in full force and effect.
14.5 Waiver. The failure of Sunday to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
14.6 Force majeure. Sunday will not be liable for any failure or delay in performing its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, government actions, labour disputes, pandemics, or system failures.
14.7 Third-party services. Certain features of the Services rely on third-party service providers, including payment processors and identity verification vendors. Your use of any third-party services is subject to the separate terms and privacy policies of those providers. Sunday is not responsible for their acts, omissions, or security practices.

Article 15 – Definitions

| Employer / Merchant | The person or entity employing you as a member of staff, or the entity operating the Establishment. |
| Establishment | Any public venue where a Merchant provides food and/or beverage services to Customers (e.g. a restaurant, bar, hotel, festival, food court, stadium, or similar) in which you work. |
| Group Company | Any company that is a subsidiary or holding company of Sunday App, Inc., or a subsidiary of any such holding company, from time to time. |
| Programme | The Sunday Rewards Programme, as described in Title II. |
| QR Code Application | Sunday’s digital payment solution accessible through scanning a Quick Response Code (QR Code). |
| Reward | A promotional incentive (point or credit) awarded under the Programme. |
| Server | An individual working as a server in an Establishment whose identifier appears in the POS system as the person who closes and/or has ownership of the table. |
| Services | The information, staff engagement, performance monitoring, tronc data display, and rewards services provided by Sunday through SFS. |
| SFS / Sunday for Staff | The mobile application developed by Sunday that serves as the primary digital interface for hospitality employees in the United Kingdom. |
| SFS Account | A user account within SFS. |
| Staff Member | An individual working at an Establishment who has accepted these Terms and created an SFS Account. |
| Sunday Data | Performance data derived from the Sunday platform, including guest satisfaction metrics, operational performance indicators, and platform usage data. |
| Territory | The United Kingdom. |
Sunday for Staff Terms of Use

These Terms of use (the “Terms”) constitute an agreement between Sunday, whose registered office is located at 112 avenue de Paris, CS 60002 94306 Vincennes Cedex (“we” or “Sunday”), and the individual accepting these Terms when registering with Sunday for Staff (“you” or the “Staff Member”). The Terms govern the provision of the following services: the Sunday Tips service and the Sunday Rewards Program (together, the “Services”).
We invite you to read these Terms carefully. With respect to the Sunday Tip, they outline the conditions under which you appoint us as your non-exclusive agent to collect, on your behalf and for your benefit, the Tips paid by Customers in order to redistribute them to you.
These Terms must be read together with our Privacy Policy, applicable to servers and employees of the Establishment, available at https://sundayapp.com/en-gb/privacy-policy-waiters-personnel/.
The provision of the Services by Sunday requires your prior acceptance of the Terms. By accepting these Terms, you confirm that you have read and agreed to them. If you do not accept the Terms, you cannot receive the Services.
We may modify these Terms from time to time, in particular to reflect changes in Sunday for Staff, Sunday Tips, the Sunday Rewards Program, or any legal or technical developments. The revised terms and policies will be made available to Staff Members. It is your responsibility to check regularly that you have read and accepted the latest version of the Terms before using our Services.
Certain terms used in these Terms are specifically defined when capitalized. Where a defined term is used, it has the meaning given in Article 20 (Definitions) or in the relevant clause of these Terms.
Title I – Sunday Tips Specific Terms
Article 1 – Description of Sunday Tips
Sunday Services. Sunday provides services that allow the collection, on behalf of and for the benefit of Staff Members, of Tips paid by Customers through the Sunday Applications, and the redistribution of such Tips to you (“Sunday Tips”).
The Merchant has entered into a separate agreement with Sunday for the provision of other services, under which the Merchant acknowledges and agrees that, with respect to the collection and distribution of Tips, Sunday acts exclusively on behalf of the Staff. The services provided by Sunday to the Merchant do not include any management of Tips and therefore do not allow the Employer to centralize Tips or to know the exact amount of Tips paid to each Staff Member.
Tips Manager. When you act as Tips Manager, you confirm that you are acting exclusively as a representative of your peers and you undertake not to communicate to your Employer the information you access in that capacity.
Sunday Partners. To deliver certain aspects of the Services (which may constitute regulated activities under applicable laws), Sunday has partnered with third parties, including payment service providers (“Sunday Partners”). The Services are subject to the requirements of these Sunday Partners, and you agree to fully cooperate with Sunday and the Sunday Partners in this context.
Bank Account. To receive Tip payments, you must hold an eligible bank account and link it to your Sunday Staff Account. By linking your bank account to your Sunday Staff Account, you authorize the payment of Tips into this account. You represent and warrant that the Bank Account linked to your Sunday Staff Account is an account of which you are the holder. You agree to promptly inform Sunday of any changes relating to your bank account.
Authorization. You hereby expressly appoint Sunday to collect, on your behalf and for your benefit, the Tips paid by Customers via the Sunday Applications and to remit them to you in accordance with the distribution rules established by the Staff and which you have previously accepted (the “Mandate”).
You thus grant us a non-exclusive commercial agency Mandate, within the meaning of PSD2, for the purpose of collecting and distributing Tips within the Territory. In this context, Sunday acts exclusively in your capacity as agent, and not on behalf of the Customer, the Merchant, or any other third party involved in the process of payment and/or distribution of Tips. In our capacity as commercial agent, you authorize us to enter into transactions with Customers on your behalf and for your benefit for the collection of Tips, including the power to bind you contractually with respect to such transactions.
Since the Mandate is non-exclusive, you retain, where applicable, the ability to collect Tips directly from Customers yourself, in addition to or instead of those collected by Sunday.
The Mandate will remain in effect until you inform us of your wish to revoke it. If you wish to revoke the Mandate, you must notify us promptly and terminate your Sunday Staff Account in accordance with Article 17 of the Terms.
Tips Distribution. You agree that Tips paid by Customers will be collected by Sunday and redistributed to you in accordance with the distribution rules applicable to your Establishment, as configured by the Tips Manager, or, in the absence of Dispatch by the Tips Manager within the period set out in Article 1 bis below, in accordance with the Fallback Dispatch procedure. These rules are available for consultation at any time in the Sunday for Staff application from your Sunday Staff Account. You understand and accept that Sunday Tips is provided for the exclusive benefit of Staff Members, without any involvement from your Employer in this respect. As such, neither Sunday nor your Employer can be held liable for the distribution rules agreed among Staff Members and/or any changes to such rules. Any subsequent modification to the distribution rules will be notified to you in the Sunday for Staff application. Payment of Tips will be made through the payment service provider linked to your Sunday Staff Account.
Tips are paid automatically every Monday following the Dispatch by the Tips Manager of your Establishment, or following the Fallback Dispatch as the case may be, through the payment service provider linked to your Sunday Staff Account. Sunday undertakes to use all reasonable means to meet this schedule. However, Sunday shall not be liable for payment delays resulting from causes beyond its reasonable control, including in the event of payment service provider failure, bank holiday, incorrect or outdated bank details provided by the Staff Member, or any force majeure event within the meaning of Article 1218 of the French Civil Code. In the event of a delay, Sunday will inform the Staff Member as soon as possible and proceed with payment at the earliest opportunity
Distribution Practices. By accepting these Terms, you confirm that the tip distribution rules applicable to your Establishment reflect a practice freely and collectively chosen by the Staff Members, in line with the customary practices of the Establishment regarding tip sharing. You acknowledge that this practice, including where it involves sharing with kitchen staff or other Staff Members who do not have direct contact with customers, is the result of a freely agreed arrangement among Staff Members, independent of any instruction from the Employer. You acknowledge that these rules do not apply in the event of a Fallback Dispatch, which is subject to the specific terms set out in Article 1 bis.
Rights and Obligations of Sunday. As the provider of Sunday for Staff and Sunday Tips, and as your agent, we undertake to:
- provide you with access to Sunday for Staff so you can create your Sunday Staff Account;
- present Customers with different options regarding the amount of the Tip they wish to pay;
- provide you with access to statements relating to the Tips distributed to you; and
- pay you the amounts due via our payment service provider (after deduction of our Commission and other fees), including, where applicable, in the context of a Fallback Dispatch in accordance with Article 1 bis.
Direct Transfer Between Staff Members (Peer-to-Peer). Where the direct transfer feature is available in your Establishment, you may freely and at your sole discretion allocate a portion of your Tips to another Staff Member, prior to any payment. This act is voluntary, individual, and cannot be subject to any instruction from your Employer or the Tips Manager. Amounts so allocated retain the nature of Tips and are subject to the same tax and social security treatment.
Article 1 bis – Fallback Dispatch
Scope. This article applies exclusively to Tips collected in the Establishment’s common pool, the allocation of which to Staff Members requires a Dispatch by the Tips Manager. It does not apply to Tips paid directly to an identified Staff Member through the direct tipping feature, which are paid individually without Dispatch.
Principle. Where the Tips Manager has not carried out a Dispatch for a weekly pool of Tips collected within six (6) months from the close of the relevant collection week, Sunday shall automatically proceed with a Fallback Dispatch of the undispatched Tips. The Tips Manager retains the right to carry out the Dispatch at any time before the expiry of this period, in which case the Fallback Dispatch shall not apply to the relevant pool. Sunday may, at its discretion, send prior notifications to the Tips Manager and/or the relevant Staff Members, provided that the absence of such notifications shall not affect the validity of the Fallback Dispatch.
Allocation method. The Fallback Dispatch is carried out in equal shares among all Staff Members holding an active Sunday Staff Account linked to the relevant Establishment at the date of the Fallback Dispatch. The allocation does not take into account the actual working periods of Staff Members during the collection period.
Acceptance and finality. By accepting these Terms, you acknowledge and agree that:
- the Fallback Dispatch is a last-resort mechanism designed to unblock the payment of Tips in the event of prolonged failure by the Tips Manager;
- the equal allocation carried out under the Fallback Dispatch may differ from the allocation that would have been made by the Tips Manager under the Establishment’s usual distribution rules;
- the Fallback Dispatch is final and may not be contested beyond a period of thirty (30) days following notification of its execution;
- Sunday shall not be liable for any discrepancy between the allocation made under the Fallback Dispatch and the allocation that would have resulted from a normal Dispatch by the Tips Manager.
Effective date. The provisions of this article shall apply to Tips collected from 1 February 2026. For Tips collected prior to that date, the six (6) month period referred to under “Principle” above shall begin to run from that same date.
Article 2 – Commission, Fees and Taxes
Commission. For each Tip collected, Sunday applies a Commission the rate of which is available for consultation at any time in the Sunday for Staff application from your Sunday Staff Account. You may also obtain your Commission rate by contacting our team at support@sundayapp.com. By accepting these Terms, you confirm that you have been informed that this rate does not exceed 25% VAT inclusive. Any modification to your rate will be notified to you prior to its entry into force.
The Commission covers the following costs: payment processing and banking fees related to the collection and payment of Tips; the provision, development and maintenance of the Sunday for Staff application; support and assistance costs for Staff Members; costs related to regulatory compliance and payment security; and costs associated with sending digital communications.
Other Fees. In addition to the Commission, we may charge you setup, subscription, and/or update fees for the use of Sunday for Staff.
Taxes. You are solely responsible for declaring the Tips you receive to the competent tax authority in accordance with applicable legal provisions. Sunday shall not be liable for your failure to meet your reporting obligations.
Article 3 – Refunds
Customers have the right, at their sole discretion, to change their mind and obtain a refund for any Tip they have given within a specified period after the transaction. If a Customer requests a refund:
- such funds may be withheld from future Tip payments; and/or
- additional fees may be debited from your Bank Account to cover the costs incurred by Sunday for processing the refund request.
Article 4 – Representations and Warranties
In addition to your other representations, warranties, and undertakings under these Terms, you represent, warrant, and undertake as follows:
- You have the right to work and to receive Tips in the Territory;
- You have the legal capacity to enter into contracts;
- the information and data you provide or make available to Sunday or any Sunday Partner in connection with your Sunday Staff Account, the Services, or these Terms are accurate, complete, authentic, and up to date;
- You authorize Sunday and each Sunday Partner to access such information and data, to use it, and to disclose it to third parties to the extent necessary to provide and manage your Sunday Staff Account, to deliver the Services, and to exercise their rights and obligations under these Terms. All information and data provided by you may be used by Sunday and any Sunday Partner without further verification.
When you act as Tips Manager, you declare that you are acting exclusively as a representative of the Staff and not on the instructions of your Employer.
Titre II – Sunday Rewards Program Specific Terms
Article 5 – Description of the Program
The Sunday Rewards Program (the “Program”) offers promotional incentives to eligible Servers, who may accumulate promotional rewards (points or credits, each a “Reward”) upon the occurrence of certain Eligible Events during their shifts.
The Program is designed to encourage the use of the QR Code Application developed by Sunday.
The conditions of the Rewards (amount, eligibility criteria, redemption terms) are specified in Sunday for Staff and may vary depending on the campaign, the period, or the Establishment.
The Rewards are purely promotional and have no monetary value until they have been redeemed in accordance with these Terms. Sunday reserves the right to modify, suspend, or terminate the Program, in accordance with these Terms.
Article 6 – Awarding and Payment of Rewards
Eligible Events. Rewards accrue as promotional incentives upon the occurrence of Eligible Events taking place during your working hours at a participating Establishment. An Eligible Event corresponds to an action defined in Sunday for Staff, which may include, for example, a Customer paying all or part of the bill through the QR Code Application for a table you have served, or any other service activity attributed to you through the point-of-sale (POS) system to which your Sunday Staff Account is linked.
The qualification of an action as an Eligible Event is determined at Sunday’s sole discretion, based on data received from the POS system and/or the QR Code Application. Only transactions and events correctly linked to your Sunday Staff Account and verified as having occurred during your active service hours are eligible.
Eligibility criteria may be updated from time to time and will be described in Sunday for Staff. Such changes will only apply to events occurring after their entry into force and will not affect Rewards already earned or in the process of being earned.
Sunday reserves the right to modify, suspend, or discontinue the eligibility criteria or the Reward structure at any time, subject to applicable law.
Reward Amounts. The amounts and conditions for awarding Rewards are determined by Sunday and displayed in Sunday for Staff. They may vary depending on campaigns, periods, locations, or Establishments. All amounts and conditions may be modified at Sunday’s discretion. Such changes will only apply prospectively and will not affect Rewards already earned or in the process of being earned under the previous conditions.
Sunday may limit the total amount of Rewards paid to an eligible Server to an annual cap, which will be specified in Sunday for Staff.
Conversion and Payment Conditions. Rewards are promotional incentives and do not constitute Tips or wages. Rewards only have monetary value once redeemed and validated by the third-party payment service provider appointed by Sunday. Once redeemed, Rewards are paid by such third parties.
Any indication of Rewards or balances in Sunday for Staff is for tracking purposes only and does not represent funds held by Sunday. Rewards that have been accumulated but not redeemed within the specified time period will automatically expire and cannot be reinstated.
To redeem your Rewards, you must:
- where applicable and if requested by Sunday, link a personal bank account to your Sunday Staff Account;
- be the legal holder of that account;
- have completed all required KYC/AML checks.
Payments are made in accordance with the schedule and procedures indicated in Sunday for Staff. Sunday is not responsible for delays caused by incorrect or outdated bank details, or by your failure to meet regulatory requirements.
Sunday reserves the right, in its sole discretion, to determine, modify, or delay the payment method, payment schedule, and any information or documentation necessary for processing payments. This may include additional verifications, updating of account information, or a change in the payment mechanism. You acknowledge that payments may be delayed or suspended until all such conditions are satisfied to Sunday’s satisfaction.
Rewards that have been accumulated but not redeemed will expire if the Establishment where they were generated ceases to use Sunday’s services before their conversion, or if your relationship with the Employer ends.
Cancellation of Rewards. We reserve the right to cancel Rewards in the following circumstances:
- the underlying transaction is refunded, canceled, voided by the system, or deemed invalid by the Establishment or the payment service provider;
- Rewards were granted in error, through fraud, misuse of Sunday for Staff, or in violation of these Terms;
- you fail to maintain an active, eligible, and compliant Sunday Staff Account.
Rewards that were wrongly granted may be recovered, including by offsetting them against future payments. By participating, you expressly agree to such cancellations and offsets.
Article 7 – Independence and No Employment Relationship
Rewards are promotional benefits and under no circumstances constitute wages, Tips, or benefits owed by your Employer. Participation in the Program is voluntary and does not create any relationship of subordination, employment, or partnership between you and Sunday.
You are solely responsible for declaring and paying any taxes applicable to the Rewards you receive.
Article 8 – Duration, Suspension, and Termination of the Program
Sunday may modify, suspend, or terminate the Program at any time. You may stop participating in the Program at any time by deleting your Sunday Staff Account or by contacting support@sundayapp.com.
Rewards validly earned before the deletion of your account will be paid, subject to your compliance with these Terms.
Article 9 – Liability in Connection with the Program
The liability limitations set out in Article 16 apply fully to the Program. In addition, Sunday assumes no responsibility for:
- the loss of Rewards that are unredeemed or expired;
- discrepancies between the data displayed in a third-party system (POS) and the data used by Sunday to calculate Rewards.
Titre II – Common Provisions for Sunday for Staff
Article 10 – Creation and Management of the Sunday Staff Account
Creation of a Sunday Staff Account. To benefit from our Services,you must create and maintain a Sunday Staff Account. This account is a user profile within the Sunday for Staff application and not a bank account. The following steps are mandatory:
- Download the Sunday for Staff application – Downloading and using Sunday for Staff is free of charge, but data or communication fees may be billed by your mobile operator. You are solely responsible for such fees and for ensuring that your device is compatible.
- Create a Sunday Staff Account by providing the requested information, including but not limited to a mobile phone number you own (which will be verified), your email address, and your first and last name.
Connection to the Point-of-Sale (POS) System. For Servers only, it is necessary to link your Sunday Staff Account to the Establishment’s POS system, for the following purposes:
- to identify the Server who closed a table in order to allocate the corresponding Tips;
- to enable tracking of service activity (for example, closed tables) for the purposes of awarding promotional Rewards and measuring performance.
You acknowledge and understand that the direct distribution of Tips by Sunday, the collection of Rewards, and access to personalized performance metrics within Sunday for Staff depend on the connection of your Sunday Staff Account to the Establishment’s POS system.
Providing Information to Sunday Partners. As part of the creation of your Sunday Staff Account, you will be required to provide certain information and data directly to Sunday Partners through an integrated framework or another solution provided by them, in order to share information about your Bank Account. You agree to provide accurate, complete, authentic, and up-to-date information. You must promptly inform Sunday of any changes to the information provided by logging in to your Sunday Staff Account and updating such information.
Responsibility for the Sunday Staff Account. You are solely responsible for all activities related to your Sunday Staff Account. You agree not to allow anyone else to access your account and to comply with all applicable laws and regulations.
Eligibility. By creating, accessing, and using your Sunday Staff Account, you represent that you are 18 years of age or older and located within the Territory. If you are under 18 or are not located within the Territory, you are not authorized to create or use a Sunday Staff Account.
KYC. You acknowledge and understand that payment of any amounts due to you is subject to compliance with Know Your Customer (KYC) and anti-money laundering (AML) requirements imposed by the payment service provider linked to your Sunday Staff Account.
Article 12 – Notifications
By accepting these Terms, you consent to receive communications from Sunday via email, WhatsApp and/or push notifications in connection with the Services. These communications may include, for example, Tip summaries, performance notifications, and other updates related to your activity as a Server or Staff Member.
Article 13 – Privacy
The confidentiality of your personal data is very important to us. All personal information you provide to us or that we collect about you will be processed in accordance with our Privacy Policy applicable to servers and employees of the Establishment, available at https://sundayapp.com/en-gb/privacy-policy-waiters-personnel/. This policy explains what personal information we collect from or about you, why and how we collect, store, use and share it, your rights in relation to it, and how to contact us or the relevant supervisory authorities if you have any question or complaint regarding our use of this information.
Article 14 – Support and Assistance
For any request relating to your Sunday Staff Account, the payment of Tips, or the payment of Rewards, please contact our support team at support@sundayapp.com. In the event of a specific delay relating to the availability of a payment, you should also contact the issuer of your bank account.
Article 15 – Intellectual Property
Sunday’s Intellectual Property. As between you and Sunday, Sunday owns all rights, including intellectual property rights and authorizations, relating to all content of Sunday for Staff and the Services, including designs, texts, graphics, images, photographs, illustrations, visuals, videos, information, logos, trademarks, drawings, button icons, software, databases, audio files, and others.
License. Sunday grants you a limited, revocable, non-exclusive, non-transferable, and strictly personal license to access Sunday for Staff and our Services. You agree not to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material related to Sunday for Staff or our Services. Your use of our Services and the features of Sunday for Staff does not grant you any intellectual property rights over them, and no assignment or license is granted to you beyond the use authorized under these Terms.
Article 16 – Liability
Availability. We provide Sunday for Staff and your Sunday Staff Account “as is” and “as available.” We make no warranty that Sunday for Staff will be free from defects and/or faults, that defects will be corrected, or that Sunday for Staff or the server that makes it available will be free from viruses or any other harmful or destructive elements. To the fullest extent permitted by law, we disclaim all warranties not expressly set out in these Terms, including, without limitation, implied warranties of fitness for a particular purpose, accuracy of information, compatibility, and satisfactory quality. While we make every effort to ensure that Sunday for Staff is secure and free from errors, viruses, and other malware, we make no warranty in this regard and you are responsible for your own security, the security of your personal data, and your devices. We accept no liability for any interruption or unavailability of Sunday for Staff. You acknowledge that we may modify or discontinue certain features or functionalities of Sunday for Staff from time to time and that we may do so without notice.
Limitation of Liability. We strive to provide a quality service. However, we shall not be held liable for delays or failures to perform our obligations (including non-payment of amounts due) resulting from causes beyond our reasonable control. In the event of a delay, we will notify you and take appropriate corrective measures. We shall not be liable for:
- any loss of income, including but not limited to loss of profits, wages, turnover, anticipated savings, contracts or business opportunities, or arising from the collection of any taxes;
- any loss or corruption of data, databases, or software; and/or
- any special, indirect, or consequential damages.
Exceptions. Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any liability that cannot be excluded or limited under applicable law.
Cap. In any event, our maximum liability to you in respect of the use of Sunday for Staff or any matter arising from or in connection with these Terms or the Services, , including the execution of a Fallback Dispatch under Article 1 bis, is limited to €500 per Server or Staff Member.
Indemnification. You are responsible for all claims, liabilities, damages, costs, or expenses we may incur as a result of your breach of these Terms. You agree to indemnify us for any claims, damages, and/or losses resulting from claims made by a third party against us due to your non-compliance with these Terms.
Article 17 – Term and Termination
Term. These Terms come into effect on the Effective Date and remain valid until one of the parties terminates them in accordance with the provisions below.
Termination by You. You may stop using the Services at any time by deleting your Sunday Staff Account via the Sunday for Staff application or by sending a support request to support@sundayapp.com to request the deletion of your account. Upon receipt of your request, we will take the following steps:
- suspend your ability to receive Tips or Rewards directly via Sunday.
- ensure that you receive any outstanding balance within 60 calendar days following your request, after deduction of any amounts you owe us.
Suspension or Termination by Sunday. We reserve the right to terminate these Terms or suspend or restrict your access to all or part of Sunday for Staff or your Sunday Staff Account, after notifying you, in the following cases:
- immediately, in the event of your breach of these Terms; or
- if we are no longer able (or no longer wish) to provide the Services;
- At the request of a Sunday Partner.
- If Sunday reasonably determines that you present an unacceptable legal, financial, operational, or fraud risk to Sunday or any Sunday Partner.
Effect of Termination. Termination of these Terms will not affect any rights accrued before the termination date, including our right to be paid or your right to receive Tips.
Article 18 – Confidentiality
Each party undertakes at all times (i) to keep Confidential Information confidential and not to disclose it to anyone, and (ii) to use such Confidential Information only for the purpose of performing its obligations or exercising its rights under these Terms. We may disclose Confidential Information to our personnel, subcontractors, representatives, and/or advisers (“Authorized Recipients”) in connection with the performance of our obligations and/or the exercise of our rights under this agreement. We will ensure that the Authorized Recipients are bound by similar confidentiality obligations.
Article 19 – Miscellaneous
Governing Law. These Terms shall be governed by and construed in accordance with French law, and any disputes arising out of them (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of Paris.
Entire Agreement. These Terms constitute the entire agreement between the parties and replace all prior or contemporaneous agreements, representations, and understandings, whether written or oral.
Assignment. You may not transfer any of your rights or obligations under these Terms to another person. We may transfer our rights under these Terms, provided that your rights are not materially affected.
Independent Contractors. Nothing in these Terms creates a partnership or joint venture between the parties or designates one party as the agent of the other, except as expressly stated. These Terms do not authorize any party to make commitments on behalf of the other party unless expressly provided.
Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a competent court, the parties intend that the remaining provisions continue to be fully valid, enforceable, and binding.
Waiver. Failure by either party to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
Regulatory Information. Sunday acts as a non-exclusive intermediary in banking transactions and payment services (IOBSP).Sunday is registered with ORIAS under number 26002072 (available at www.orias.fr) and is supervised by the Autorité de Contrôle Prudentiel et de Résolution (ACPR) – 4 place de Budapest, CS 92459, 75436 Paris Cedex 09.
Article 20 – Definitions
The following words and expressions have the meanings assigned to them in these Terms:
| Commission | the fee that we are entitled to deduct from each Tip as compensation for providing the Services. |
| Confidential Information | Any information designated as confidential or that should reasonably be understood as confidential by its nature. This includes, but is not limited to, information visible within the Sunday for Staff application. |
| Customer | a patron or client of an Establishment. |
| Dispatch | The action by which the Tips Manager allocates the Tips collected to Staff Members, in accordance with the distribution rules configured in Sunday for Staff. The Dispatch triggers the automatic payment of Tips to Staff Members on the following Monday. |
| Effective Date | The date on which your Sunday Staff Account is created |
| Eligible Event | an event giving rise to Rewards. |
| Employer/Merchant | The person or entity employing you as an employee. |
| Establishment | Any public venue where a Merchant provides dining or bar services to Customers (e.g., a bar, restaurant, food court, festival, stadium, or similar setting) where you are employed. |
| Fallback Dispatch | An automatic Dispatch mechanism carried out by Sunday in lieu of the Tips Manager, under the conditions set out in Article 1 bis of these Terms. |
| PDQ Application | sunday payment application accessible on a Process Data Quickly device (PDQ device). |
| QR Code Application | sunday payment solution accessible through scanning a Quick Response Code (QR Code). |
| Reward | Promotional benefits awarded under the Program. |
| Server | an individual working as a server in an Establishment whose name often appears on the bill as the person who closed the table. |
| Staff | All individuals working for an Establishment as employees, including Servers, but excluding individuals in managerial or administrative roles who do not interact directly with customers (e.g., HR department employees). |
| Staff Member | An individual who is part of the Staff and has agreed to these Terms to benefit from the Services. |
| Sunday Applications | Collectively, the QR Code Application and the PDQ Application. |
| Sunday for Staff | The application developed by companies within the Sunday group, allowing Staff Members to access the Services. |
| Sunday Staff Account | a user account within Sunday for Staff. |
| Sunday Tips | a Sunday service exclusively available to Staff Members who have downloaded and accepted the terms of the Sunday for Staff application, enabling them to receive Tips. |
| Territory | France. |
| Tip | A monetary amount voluntarily given to Staff by a Customer through Sunday Applications. |
| Tips Manager | the Staff Member who has accepted, voluntarily and explicitly in the Sunday for Staff application, to perform the functions of managing the tip distribution rules and Dispatch on behalf of their colleagues. The Tips Manager acts as a representative of the Staff and not as a representative or agent of the Employer. Regardless of their role within the Establishment, the information they access in performing these functions is strictly attached to their capacity as a representative of the Staff, may not be communicated to the Employer, and is not deemed to be known by the Merchant for the purposes of applicable social security and tax provisions applicable to Tips. In the event of prolonged absence of Dispatch by the Tips Manager, the provisions of Article 1 bis (Fallback Dispatch) shall apply. |
